Terms and Conditions

 

Please read the Terms and Conditions in their entirety. This agreement documents the legally binding terms and conditions associated with Helping Writers Write and their services. These terms and conditions govern all preceding events and communications. You are hereby agreeing to these Terms and Conditions in full.

If you object to any of the Terms and Conditions described below do not continue.

 

Payment Terms

Before Helping Writers Write begins work a non-refundable deposit in the amount of one-third of the final fee is required for services over $500. It will be secured and will be offset against your final invoice upon project completion. The remaining balance will be billed according to mutually agreed upon dates.

Payment in full is required for all other services before work begins with the exception of Ghostwriting, which requires a separate contract and consultation.

All payments shall be made in United States dollars. Helping Writers Write will invoice you within 3 business days. In the event of an overdue payment, an additional 20% will be added to the original amount due. Late payment is considered a breach of contract entitling Helping Writers Write to suspend work or cancel the contract.

Any changes to the approved Content Creation Brief are subject to additional fees and deadline extensions. No cancellations will be accepted. All collected fees and applicable recurring payments are non-refundable.

All orders must be redeemed within 120 days of the purchase date. After that time, you will forfeit all monies paid.

Helping Writers Write reserves the right to cancel an order if we deem it does not align with our guidelines and corporate policy. In such circumstances, you will be given as much notice as possible and a full refund of fees paid.

All completed orders will be stored in our files for 1 year.

Delivery

Standard delivery is up to 5-7 business days from the first full business day AFTER the date we receive your completed Content Creation Brief and the 30-minute Content Creation Consultation call has occurred.

For example, if you submit your Content Creation Brief on a Tuesday at 4 p.m. your time, and we complete our consultation call on Wednesday at 5 p.m.,

Helping Writers Write will begin your order within 24 hours. In this scenario, your agreed-upon delivery time countdown would start Thursday when your order is started. In most instances, your order will be received by you before the 7th business day, but 7 days is the maximum, barring any unforeseen circumstances. 

Note that orders received on weekends and office-observed holidays will be processed the following first full business day.

Helping Writers Write shuts down once each year and observes the following holidays: New Year’s Day (observed Monday, January 2), Martin Luther King, Jr. Day, Easter (observed on Good Friday), Memorial Day, Juneteenth (observed Monday, June 20), 4th of July, Labor Day, Thanksgiving (+ Day After Thanksgiving), Christmas Day (observed Monday, December 26) and New Year’s Eve (observed Friday, December 30). The holiday list is subject to change with notice.

Gift Cards

Redeemable at HelpingWritersWrite.com for all available services, digital products, and physical products listed. Gift cards cannot be applied to courses, webinars, or workshops. Valid for one (1) year from the date of issue. For gift card balance, terms, and expiration date, contact helpingwriterswrite@gmail.com.

Warranties

Helping Writers Write’s services are provided without any warranties, express or implied. Any warrant implied by statute or law is excluded to the maximum extent permitted.

Responsibilities Of The Client

In order for Helping Writers Write to provide its services effectively, the client shall be solely responsible for the following:

  • Providing and approving relevant and appropriate content creation brief

  • Providing all necessary marketing information applicable to the project

  • Completing a 30-minute content creation consultation

  • Cooperate with respect to the efforts made by Helping Writers Write to meet the requirements of the agreed upon book coaching, editing, content creation, or ghostwriting project’s specifics.

  • Providing notice of any changes to regularly calendared sessions 48 hours in advance                               

  • Communicate any concerns within 24 hours of project completion

Revisions/Rewrites

A thoroughly completed content brief and transparency during our 30-minute content creation consultation is the best way to ensure that your needs and requirements are met. Your content will be written to your specifications. Helping Writers Write does not provide rewrites if you change your mind, your needs change, or simply don’t like the content. We will rewrite content where we have misunderstood the guidance provided in your content creation brief. If this happens, Helping Writers Write is happy to offer one rewrite at no charge.

If we do miss the mark, please send your rewrite request to us at helpingwriterswrite@gmail.com and schedule a call on our calendar within 7 business days of receiving your original content.

Helping Writers Write will ask questions for further clarification about the reason for your rewrite request and you’ll need to respond within 2 business days. Your rewritten content will be delivered within 5 business days of receiving ALL requested follow-up information.

*** Note that failure to submit your revision request and respond to all questions will void your opportunity to receive a rewrite.

Copyrights

Copyright in all published content (such as text produced on your behalf) will pass to the client upon completion of the project for all projects where payment has been rendered.

Confidentiality

Both parties, Helping Writers Write and the client, assume the responsibility of complete confidentiality at all times. They will not disclose or permit the disclosure of, any confidential information including, but not limited to, marketing, sales, techniques, ideas, manuscripts, information, or data to a third party without prior written consent, excluding information in the public domain.

Liability

Helping Writers Write will provide its services to you in a professional and workmanlike manner. Under no circumstances is Helping Writers Write or its employees, officers, directors, or affiliates liable for any losses due to delay in service deliverables, where the delay is because of unforeseen, natural, or ungovernable causes. Helping Writers Write will not be liable to you for indirect, consequential, exemplary, punitive, or special liability under the law of contract, torts, or otherwise. Losses include, but are not limited to, loss of revenue, profits, reputations, or time investment. If you are advised on potential losses the limitations of liability still apply.

Severability

If any provisions are deemed by a court or other competent authority invalid, unlawful, or for any other reason unenforceable under applicable law it shall be deemed severable and will not impact or affect the validity or enforceability for the remaining provisions.

Any invalid, unlawful, or unenforceable provisions will be deemed as such and deleted, the rest of the provisions will continue to remain in effect.

Governing Law and Jurisdiction

These Terms and Conditions will be governed by and construed in accordance with New York State Laws. Any disputes between the client and Helping Writers Write will be subject to the non-exclusive jurisdiction of the state and federal courts located in New York State for the resolution of any aforementioned disputes.

Entire Agreement

These Terms and Conditions, along with any other legal notices or disclaimers posted,

constitute the entire agreement between you and Helping Writers Write.

The most current version supersedes all previous agreements. Helping Writers Write reserves the right to modify or update these Terms and Conditions at any time they see fit. Accepting this agreement constitutes your formal acceptance of all updated Terms and Conditions and it is up to you to monitor and check for updates. Should you change your mind and object to any of the provisions we ask that you contact your representative and discontinue use immediately.

 

Hours of Operation

Helping Writers Write operates during standard business hours and is NOT available on weekends. Our office hours are as follows:

Monday-Friday : 9 a.m. EDT – 4 p.m. EDT

Saturday, Sunday, and Holidays: CLOSED

* * Calendar spaces are limited, so please be sure to book your slot once your Content Creation Brief is completed.
